Terms of Service

1. Acceptance of terms
By accessing or using the MessageFlow platform ("Service"), operated by Datanetics (Pty) Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users, including organisation owners, administrators, agents, and viewers.
2. Description of service
MessageFlow is a multi-tenant messaging automation platform that enables organisations to:
- Design and run conversational flow campaigns via WhatsApp, Telegram, and SMS.
- Manage a shared inbox for customer conversations across channels.
- Send broadcast messages to contact lists using approved templates.
- Automate workflows triggered by message events, keywords, and contact changes.
- Manage contacts, deals, and a sales pipeline linked to conversations.
Access to the Service is provided on a per-organisation (tenant) basis. Each organisation's data is logically isolated from all others.
3. Account responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account and your organisation's workspace.
- You must notify us immediately at cj@datanetics.co.za if you suspect unauthorised access to your account.
- Organisation owners are responsible for managing team member access and role assignments.
4. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk messages (spam) to contacts who have not opted in to receive communications from you.
- Violate Meta's WhatsApp Business Policy, Telegram's Terms of Service, or Africa's Talking's acceptable use guidelines.
- Transmit illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content.
- Attempt to gain unauthorised access to other organisations' data or the platform infrastructure.
- Use the Service in a way that disrupts, degrades, or impairs its availability for other users.
- Reverse-engineer, decompile, or attempt to extract the source code of the platform.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Channel credentials & third-party APIs
You are responsible for:
- Obtaining and maintaining valid API credentials for WhatsApp (Meta), Telegram, and SMS providers used through the platform.
- Complying with the terms of service of each third-party messaging provider.
- Ensuring that your WhatsApp Business account is approved by Meta and that message templates comply with Meta's template policy.
- Obtaining appropriate opt-in consent from contacts before sending them messages via any channel.
MessageFlow is not responsible for message delivery failures, API rate limits, or account suspensions imposed by third-party providers.
6. Data ownership
You retain full ownership of the data you import or create in your organisation's workspace, including contacts, conversations, campaigns, and templates. By using the Service, you grant us a limited licence to process and store this data solely for the purpose of providing the Service to you.
We do not claim ownership over your data and will not use it for any purpose beyond operating and improving the platform as described in our Privacy Policy.
7. Availability & service levels
We aim to provide a reliable service but do not guarantee 100% uptime. The Service is provided "as is" and "as available". We may perform maintenance, apply updates, or experience downtime due to factors outside our control.
We will endeavour to notify you of planned maintenance where practicable.
8. Limitation of liability
To the fullest extent permitted by applicable law, Datanetics (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to loss of revenue, loss of data, or reputational harm.
Our total liability to you for any claim arising from these terms or your use of the Service shall not exceed the amount you paid to us in the three months preceding the claim.
9. Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service with or without notice if you breach these Terms, fail to pay applicable fees, or if we discontinue the Service.
Upon termination, your organisation's data will be retained for 30 days before permanent deletion, in accordance with our Privacy Policy.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
11. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
